Trump administration moves to crack down on asylum claims

"US law is crystal clear that asylum seekers have the right to lodge asylum claims regardless of where they enter the country, and President Trump can not change the law on a whim", said Bill Frelick, Refugee Rights director at Human Rights Watch.

Trump told reporters that he had "just signed" the proclamation as he departed the White House on Friday morning en route to Paris.

The rule, which prevents migrants from claiming asylum if they do not do so at an official border crossing, is the latest attempt by the White House to handle a surge in migration to the USA from the Central American countries of Guatemala, Honduras and El Salvador.

The rule will also likely to face steep legal challenges from immigrant advocacy groups who say the new rule violates decades-old asylum laws.

The restriction on asylum claims will seek to address what a senior administration official called the "historically unparalleled abuse of our immigration system" along the border with Mexico. Once triggered, it would give the government the power to deny asylum claims to illegal immigrants.

"Asylum-seekers have been left to camp out for days and weeks on bridges at the border, when they should be guaranteed a right to enter the country for a fair hearing".

Trump's proclamation does not apply to unaccompanied children, officials said.

The president can stop migration in the "national interest", a statement said.

Under US law, there is a legal obligation to hear asylum claims from migrants if they say they fear violence in their home countries.

The current policy allows migrants - no matter how they entered the United States - up to a year to make an asylum claim.

Slate reported on November 5 that Kavanaugh has declined to "run interference" for Trump in three of his early rulings - when he declined to rule on the controversial citizenship question on the 2020 Census; when he did not publicly share his vote on the deposition of former commerce secretary Wilbur Ross and stayed mum on the court's decision to punt the legality of the citizenship question to a circuit court. As such, it is likely to be challenged in federal courts.

The regulation would largely affect migrants from the Northern Triangle - Guatemala, Honduras and El Salvador - who have been crossing the U.S. border with Mexico. Before the midterm elections, Trump mulled ending birthright citizenship - the policy that ensures all children born on United States soil are automatically citizens - by executive order. "Any person in the United States must have access to the asylum process". Several smaller groups were trailing hundreds of miles to the south; officials estimated about 7,000 in all were in the country in the caravans. Most have passed largely unnoticed.
