Cuomo calls on ICE to "cease and desist" after farm raid

Cuomo, in what he called a cease-and-desist letter to U.S. Immigration and Customs Enforcement acting Director Thomas Homan, expressed dismay over a recent spate of raids by federal agents that he called "reckless and unconstitutional enforcement actions".

Arrests Cuomo cited as possibly illegal included one made on a dairy farm, one in a private residence and one targeting a local immigration activist.

John Collins said the agents who entered his farm in the Town of Lee did not identify themselves or produce a warrant before they arrested farmhand Marcial de Leon Aguilar on charges that he unlawfully re-entered the USA following several previous deportations.

"We believe ICE is violating the law and endangering public safety", said Cuomo.

"Many of these arrests were conducted at large in the community, which ICE is increasingly forced to do due to sanctuary policies in the state that prevent us from taking custody of criminal aliens in the secure confines of a jail", he added. A spokesman did not immediately respond to questions about the officers' conduct Wednesday.

In addition, agents arrested a male defendant at State Island Criminal Court.

ICE has said that it did have a warrant. Cuomo said he is waiting on a response from ICE officials.

"The persistent failure of your agents to properly identify themselves or produce required documentation to conduct lawful searches and arrests is illegal and creates significant risk of harm to all New Yorkers, including law enforcement who have also been left unaware of your activities within the communities they are entrusted to protect", Cuomo wrote in the cease-and-desist letter.

"This is about politics", Cuomo said. "We can not allow these illegal raids to continue".

"I think ICE is responding to this.political rhetoric".
